Bombay High Court breather for Adnan Sami

In a relief to singer Adnan Sami, the Bombay High Court on Monday stayed a family court order directing him to pay Rs 6.4 crore to his former wife Sabah Galadari.

A family court had directed Mr. Sami to pay Ms. Galadari the sum as compensation, repayment and meher (money given by husband to wife after marriage). He was also asked to surrender his duplex flat in Andheri, which he had gifted to Ms. Galadari when they were married.

The court also allowed Mr. Sami to stay in the Andheri flat with his family. Ms. Galadari has been restrained from creating any third party interest in the duplex flat.

Mr. Sami, in his appeal, had claimed that the lower court order had failed to take into consideration the Enforcement Directorate's order, which allegedly stated that he had no legal title, and thus could not gift the suit property.

"The order of the family court is erroneous, illegal, ultra vires, contrary to settled principles of law, and is unsustainable," Mr. Sami's appeal had stated.

He had bought a duplex flat in Oberoi Sky garden in Andheri a few years ago. He had gifted it to Ms. Galadari some time when they were in wedlock between 2001 and 2004, and 2007 to 2012. The couple had got remarried after its first divorce.

But after the couple finally parted ways in 2012, Mr. Sami refused to hand over the flat to Ms. Galadari.
