State government directs for alternative arrangements
The state government has directed to deem mass leave of doctors and employees on January 31 as unathorised absence from duty and apply break-in-service rule against those taking part in it. The state government has invoked Essential Services Maintenance Act (ESMA). Those violating it will attract action as per provisions of the Act.
In clear-cut directives to All Joint Directors Health, Chief Medical and Health Officers and civil surgeons, the Health Department these services have been declared as essential under Essential Services Maintenance Act 1980 (ESMA). Government servants in Madhya Pradesh have been prohibited under rules 6 and 7 of Madhya Pradesh Civil Service (Conduct) Rules, 1965 from demonstrations, participating in strikes and going on leave without prior permission. Decision of Madhya Pradesh Medical Officers Association and other organisations to go on mass casual leave on January 31 is also prima facie against directives of the government. Directives have been given to continue health services unabated in the public interest. For this, services of AYUSH and private doctors will be sought.
